| PLEA TO THE BRAZILIAN SUPREME COURT: NO AMNESTY FOR TORTURERS! |

| Honorable Supreme Court judges, you currently have before you a case of immense importance for both the history of Brazil and its future as a democracy founded upon the rule of law. ADPF (Argüição de Descumprimento de Preceito Fundamental) nº 153, presented by the Federal Council of the Brazilian Bar Association (Ordem dos Advogados do Brasil) in October 2008, requests that the Brazilian Amnesty Law be interpreted to prohibit its application to ordinary crimes committed by agents of repression against political opponents during the military regime. |

| Torture, murder and forced disappearances are crimes against humanity and, as such, cannot be the subject of amnesties or self amnesties. Moreover, the trivialization of torture is a sad legacy of the military dictatorship, and continues to have a direct effect on society. Brazil is the only country in Latin America that still has not prosecuted the agents of repression from its military dictatorship. It is therefore imperative that the Amnesty Law be interpreted in a way that gives primacy to the respect for human dignity. |

| Scientific studies have shown that impunity for crimes perpetrated in the past gives rise to the continuing use of violence by state agents. Indeed, state agents in Brazil continue torturing and committing extrajudicial killings against the poor population at alarming rates. As such, denying amnesty to torturers and murderers would not only address Brazil’s unfortunate distinction as the only Latin American country that still accepts the legitimacy of political amnesties for the inhumane practices of its military dictatorship. It would also help cease the social exclusion of a considerable portion of the Brazilian population, who even today lack access to basic democratic rights. |

| We are confident that the Federal Supreme Court will interpret the Law in a way that strengthens democracy in Brazil, because truth and justice are principles to which Brazil is committed at the national, regional and international levels. The judges of the Supreme Court have the noble mission of strengthening democracy and providing victims, their relatives, and the Brazilian people with the answers necessary for the construction of peace. |
